SOLKARI TERMS OF SERVICE

Solkari Administration reserves the right to change these Terms of Service at any time with or without notice. If there are major changes to these terms an announcement of said changes will be made. 

By participating in Solkaries, you agree that you have read and agreed to the rules below.

GENERAL RULES AND USER BEHAVIOR

 

  • All users are expected to be respectful and civil in all interactions both with other users and with Staff regardless of the situation or circumstance. 
    • The Solkari community  is not a place for venting, ranting, or overt negativity. Please do not bring up topics that can be overly upsetting and/or harmful in a public setting. 
    • Participation in both the Solkari site and discord server is a privilege not a right. Any violation of our Terms of Service can result from a warning, strike, or ban depending on the severity of the violation.

 

BEHAVIORS THAT WILL RESULT IN A WARNING, STRIKE, OR BAN:

  • Curse words are not allowed within the Discord server or on the Solkari site regardless of if they are not being used to harass someone. 
  • Any discrimination or hate speech is prohibited. We consider hate speech to be any form of expression that either attacks other people or promotes hatred or violence against them based on their protected characteristics.
    • We consider the following to be protected characteristics: age; caste; color; disability; ethnicity; family responsibilities; gender; gender identity; housing status; national origin; race; refugee or immigration status; religious affiliation; serious illness; sexual orientation; socioeconomic class and status; source of income; status as a victim of domestic violence, sexual violence, or stalking; and weight and size.
  • Bullying and harassing users will not be tolerated. This includes on the discord server, in discord DMs, Solkari website, or any other Social Media that targets the species and its members.  If there is a concern with another user that cannot be solved by blocking, please contact a mod. However, we require proof of TOS being broken and cannot go off of “Good faith” statements. Please provide, to the best of your ability, transcripts, screenshots, or any other relevant information. 
  • Name-dropping or publicly gossiping about an individual to stir up drama, regardless of if they are present or not. 
  • Discussing other Species that are NOT an affiliate is prohibited. 
  • Discussing rumors, scandals, or any malicious/negative situations of individuals, groups, or species.
    • Any user found to be posting harassment or any above topics on “hate” and “drama” blogs will receive a strike. Both of these instances are malicious and directly violate our rule of respect towards the community. 
  •  Begging, guilt-tripping, or harassing members or staff to try and gain characters, lower pricing, items, currency, or artwork is unacceptable behavior and will result in a Strike. All adopts, items, and currency of Solkaries are an artist made luxury item and not a necessity. This includes harassing another user to sell or trade any designs and/or adopts when they are not explicitly listed as on sale or up for trade offers.
  • Creating off-brand Solkari characters or species and trying to sell them off will result in a strike. This includes copying another's design trying to sell it off as a different species. 
  • Scamming other users by attempting to cheat them out of characters, items, and/or currency or attempting to sell a character that does not belong to you, or accept money and not transfer a design to a buyer will result in a strike and/or lead to a ban. 
  • Reselling Solkari for more than their official value. If you’d like to appraise your Solkari’s value you may do so by following the rules under the Appraisal section. 
  • Creating multiple on-site accounts to obtain on-site currency/. Items, or to participate in sales and raffles or any other means to profit off the Species will result in an immediate ban from this species. 
  • Pretending to be an Admin, moderator, staff, Guest Artist, or Event Team Member may result in a ban depending on the severity of the situation. 
  • Posting any NSFW content is strictly prohibited. By posting any NSFW content within the server or on the Solkari site will result in either a strike or being blacklisted from the species depending on the severity of the violation. 
    • If you are unsure if something may be NSFW you may talk to a Staff member for clarification. However, the simple rule is if you would not show it to your parents, guardian, or a child then you should not share it in the Solkari site or discord server.
  •  Suggestions and critiques are welcome! As long as it is constructive and civil. We will not tolerate any hateful or cruel messages directed towards members or the Staff team. If suggestions or criticism devolve to name-calling or bad faith arguments towards anyone, a warning will be given out to all involved. We encourage members to voice their opinions and highly appreciate suggestions, but we must also consider the wellbeing of all staff and members. Therefore, a moderator may ask members to temporarily drop a conversation if it is getting out of hand and is too much for the available moderators to handle or is overtly nitpicky or inconsiderate. Once a moderator asks for a topic to be dropped and discussed later, it must be dropped immediately without any ‘last words’ added in. Ignoring this will result in a warning.
  • Staff members are allowed to ban users based on prior experiences or evidence brought forward about said users that are found to be factual and true.

 

WARNINGS, STRIKES, BANS, AND BLACKLISTS

 

All warnings, strikes, bans, and other personal matters will be handled and discussed privately with the individuals involved. No personal information will be given out to other users. This includes the disclosure of how many warnings, strikes, etc. a user has at any point in time. 

  • WARNING, when a warning is given it means to stop whatever is being done that violets our TOS. Once 3 separate warnings have been given to the same user it will result in a strike. 
  • STRIKE, a strike may be given without prior warnings for larger and more intentional rule breaks. Once a user has received 3 strikes they will be temporarily or permanently banned from this species. A user can earn multiple strikes at once for serious infractions. 
    • We reserve the right to instant ban someone without warning in serious situations. 
  • TEMPORARY BAN, means a user is banned from participating in any group-specific games, sales, events, giveaways, and any other group related activities for a set period of time. During a ban period the user may trade, gift, or sell their Solkari, items, or slots but will need to provide proof of the transactions to a Staff member. Once the time frame has passed the member is allowed to rejoin group specific activities. However, if proof of malicious or non-changed behavior is received the ban can be extended or become permanent. 
  • PERMANENT BAN, means the user is not allowed to participate in any group-related activities, interact on the Solkari Discord, website, or any other social media. The user will be given a set time frame to sell, trade, or gift away their in game currency, items, and characters. After this time frame all remaining items and characters will be voided and removed. This user may no longer receive any Solkari adopts, slots, etc. 
  • BLACKLIST, members on this list are not allowed to own any designs in the Karurium species, create any designs, own any MYO tickets, or participate in the species. This includes; entering events, joining raffles, becoming a member of the TH world, website or Discord server, and purchasing or otherwise gaining MYOs and designs from an official source or through a member. Adopts and MYOs owned/created by these people will be voided if they remain in the possession of the blacklisted user for more than two weeks after blacklisting. Additionally, purchased MYO will not be refunded to these users, as they have knowingly broken our rules.

 

ACCOUNTS

 

  • You must be at least 13 years old to participate in the Solkari species. Both the website and the Discord server.
  • You need to have an on-site account (linked to either your Toyhou.se or DeviantArt account) in order to interact with the species activities.
  • When you create an account you must provide us with information that is accurate, complete, and current at all times. Failure to do so is a breath of the Terms and may result in the immediate termination of your account on our service. 
  • You are responsible for safeguarding your password that you use on our site. Whether your password is without service or a third-party service. Do not share your password with anyone!
  •  Account-sharing is prohibited. Two people are not allowed to use one account together, each must have their own separate account. If an account is found to be shared it will be terminated. 
  • Usernames that are inappropriate or copyrighted are prohibited. If a username is found to use the identity of another person or entity that is not lawfully available to use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar, or obscene will result in the termination of your account. 
  • Links in regular Users’ profiles are not verified by the mod team. Clicking on any links not provided by the site or moderators is to be done carefully. However it is forbidden for Users to include any content in their profiles that breaks any of our rules. If you find any suspicious, NSFW or otherwise rule breaking links or User profiles please report these to a moderator directly or through the Report button on the User’s page (triangle next to their Username).

 

ADOPTABLES

 

PURCHASES AND BIDDING | TRADE AND RESELLING

 

  • Refunds for MYO slots and Adoptables are not available. However, you may sell your Adopt or MYO slot for what you purchased it for. The only way you can sell an Adopt for more than the purchase price is for it to have quality add-ons and be appraised. See the Appraising section of these TOS.
    • You must agree to an Artist’s Terms of Service when purchasing an Adopt from them. We do not police how a Guest Artist sells their Adopt; however, if there is a clear issue of scamming or unlawful acts do inform a moderator or Staff member.
    • You can NOT sell a MYO design for real currency. You may gift or trade a created MYO but it cannot be sold. Even if you paid real currency for an MYO slot, as soon as it is turned into a design it cannot be resold. A MYO is not an Adopt and will not be treated as such. Violating this will result in a strike and/or a ban. 
  • Always make sure to tag the person you are outbidding! You must make sure the person before you is aware they have been outbid. Failure to do so will result in a warning and can lead to a Strike. 
  • Never delete or remove your bid. Under no circumstance should you ever remove your bid message. If you need to back out of a bid do so in a separate message. It can be as simple as “I’m sorry I must retract my bid!”. Failure to do so will result in a warning, if continued it can lead to a strike or a ban. 
  • Never edit your bid message. If you edit your bid message/comment to lower the price you will receive the same consequences as above. 
  • Never bid what you cannot pay! Be responsible and only bid what you can afford. Even if it means you will not win the Adopt you may want, do not put yourself and others involved into an otherwise avoidable situation. 
  • You must pay within 24 hours after winning an Adopt. Failure to do so without any notice will result in a strike and can lead to a ban. If an issue arises, discuss it with the artist. The artist has the right to choose the bidder before you or reopen the bidding on the Adopt if the transaction falls through.
  • Stay on top of Art payments. You must stay in communication with the Artist of the Adopt you are creating Art to trade for. Failure to deliver the Adopt without proper communication will be treated the same as failure to deliver monetary payment and result in a strike and can lead to a ban. The artist has the right to choose the bidder before you or reopen the bidding on the Adopt if you fail to deliver you part of the trade.
  • Do not ask for specific Solkaries unless they are up for trade/sale and/or you’ve gotten permission from the owner. 
  • Do not message another user asking if they will sell/trade a Solkari. This is disrespectful and will result in a warning. 
  • Do not complain or guilt-trip about the value of a Solkari. These are a luxury item and not a necessity!
  • MYO Solkari slots can be purchased from The Beyond on occasion or gained from an activity. These slots are only valid when they are uploaded to the MYO slot Materlist on the Solkari website.
  • Refunds and Chargebacks are not accepted. Attempting to do so by using features such as paypal’s chargeback will result in a permanent ban. Exceptions for extreme situations may be made with proper evidence.
  • Designers retain partial rights to their design. They should be credited for their artwork and design and have the right to distribute, reproduce, and display in their online galleries. Artists cannot reuse or resell the design for personal and commercial projects, unless the design has been traded back to them. 
  • Artists have the right to refuse sale or service to anyone at their own discretion. This may occur due to a brand-new/ unverified account or a user with repeat rule-breaking.
  • We are not responsible for any unofficial or stolen Solkari characters you may purchase or trade outside of the Solkari community. It is your responsibility to resolve the situation. You may report the incident but we cannot guarantee compensation. We only have control over the sales within our community. Users found to have made false sales will be punished with a temporary or permanent ban. 

  

OWNERSHIP

 

  • You do not have to participate in Events to own a Solkari. However, do note that the purpose of a Solkari is to be used as part of the narrative and game-play. 
  • You cannot create an official Solkari unless you have a MYO slot or are a Guest Artist. In order to have an official Solkari it must be approved and given an official dex number. Pretending to have an official Solkari despite not having the proper approval will result in a strike.
  • You cannot claim a character as a Skyling without official approval. Skylings play a part in the narrative and must be properly listed with an official dex number to participate. 
  • Do not make characters based on Copyrighted material. While it may be tempting to make a character based on people and characters, these kinds of characters are not allowed! You may take inspiration from other sources but do not copy others' designs!
  • We do not have control over what a person does with their characters. We do not condone inappropriate character development, but cannot and will not interfere with a user’s personal choice unless they directly violate our Terms of Service. 

 

 

 DESIGNS AND REDESIGNS

 

  • We have the right to deny any designs for both Solkari and Skylings. While we cannot control the backgrounds on character, designs must follow or Terms of Service to be accepted. 
  • Designs for official Solkari must follow the MYO Guide. The MYO Guide can be found here.
  • Skylings have some regulations of their own. They can be found here. [<- LINK]
  • Large Edits to a Solkari require redesign permissions. This means changing distinctive traits such as halo, bodymarkings, etc. It requires a ticket and the Solkari must go through the approval process. 
  • Be patient when awaiting a design or redesign approval. A submitted request may take a couple of days for a moderator or Staff member to review. 

 

 

VOIDING

  • A user may request to have a Solkari or Skyling removed from the game entirely. This means the character will be removed from the Masterlist and no longer have an official dex number attached.
  • Voided characters cannot participate in Activities. Once a character has been voided it is no longer associated with Solkaries. 
  • Voided characters cannot be associated with Solkaries. As mentioned above they cannot participate in events but they also cannot have the Solkari name attached to them. Once voided any association including backstory must be changed to remove any and all association. 
  • Void a character by contacting a moderator. Specify the character you would like to have voided and confirm the agreement to the terms of voiding a character before it is permanently voided. Moderators, Staff members, or normal members are not allowed to question why a user has decided to void their characters. That is the user’s personal business. 
  • Characters clearly being pretended as an official character of Solkaries should be reported. Any Solkari and/or Skyling claimed to be official but does not have an official dex number should be reported to a moderator. 

 

APPRAISING

 

  • A Solkari Adopt can be appraised to raise its value from the original price if it has additional artwork/writing attached to it.
  • Gift Art, prompt submissions, and any pieces purchased with Solency do not raise a Solkari’s value. Any artwork received for free or has already received an award for a prompt or event will not count towards raising a Solkari’s price.
  • You may only appraise a Solkari Adopt if you plan to sell or trade it. Do not have a Solkari appraised out of curiosity as this process takes time and should not be abused. Failing to follow through with a sale or trade after appraising will result in a strike. 
  • Contact a Staff member to have your Solkari adopt appraised. Be sure to include information on which adopt you would like to sell/trade.

Personal work: Any artwork done by you counts for half your commission prices. Attach proof of your commission prices for reference.

Commissioned work: Any artwork commissioned for full currency counts at the full value the artwork was purchased at. Include proof of receipt in order to have that value added. 

Trade Work: If you completed an art trade with someone, YOUR part of the trade and will take the full value of your commission work. Attach proof of trade and your commission prices. 

Attempting to raise commission prices or altering other data to raise an Adopt’s sell price will result in a permanent ban! 

 

LIABILITY AND DISCLAIMER

  • All users are not above the law including Staff members, and moderators. If you see a member of the staff or moderator team overstepping boundaries you can report them and the issue will be investigated. 
  • We are all human and make mistakes. This goes out to everyone from the Admin, Staff members, moderators, and users. Treat each other with respect and work to find a civil solution to an issue rather than lashing out. Every situation will be reviewed and given the proper consequence that coincides with the severity of the issue. 
  • Your use of our site is at your sole risk. Our site is provided without warranties of any kind. We cannot promise the site will be free of issues, such as bugs, viruses, or other harmful components. However, we strive to keep our site functioning and clean. 
  • Discontinue using our site if you do not agree with our Terms of Service at any time. If you choose to continue using our site then you automatically agree to follow our Terms of Service and will be held accountable to it.
